Ok my friend is a born white American citizen and she married a Mexican here on a work visa. One can not only have a work visa and then jump to citizenship, doesnt happen that way. 

 

What has to happen is that your friend would have to file an I-130/I-485, it has to be approved.  This would make him an LPR, Lawful Permanent Resident.  If he was illegal, it doesnt matter what was filed he could not become an LPR.  The I-130 could be approved and if another amnesty happened he would already have his date down.

 

Once you are an LPR, if through marriage, there are two ways to become a citizen, one is in 3 years and that is if you are still married or the other is 5 years and that doesnt matter if you are married or not.  If it was employment based the person would have to wait 5 years.

 

You story doesnt make sense because you are missing the step of LPR status.  Also if I saw someone that had an attorney for citizenship I would think something was wrong, because people dont normally bring lawyers for something like that.

 

Also, an attorney would never tell you this information because this person could get disbarred because he is breaking attorney/client privilege.

The lawer did not tell me details on the case but he comfirmed that people are being deported without having a felony. As for the story sorry I do not have all the details and my friend did not say LPR status she used the term papers. After I talk with her again then me and her can go into more detailws but her husband still did not have a felony.
