03/07 Dr. Phil Now: Sex Offenders Next Door

I watched about 35 minutes of this episode and I was completely sickened not by the people who were furious about having sex offenders in their neighborhood but by the fact that A persons sex offender status makes them a  bad person to many people. Alot of people need to realize that even though a person is labeled as a sex offender doesn't mean they are one you don't know their personal story you only know what little information that is put on the persons sex offender profile case in point when I was 17 I met a gentleman who told me he was 29 I met him while I worked at a local grocery store he was a regular customer always came through my checkout line and we made small talk I ended up pursuing a relationship with him. It ended up being a sexual relationship but it was completely consensual along the line I ended up finding out he wasn't 29 he was 38 but I still kept seeing him. I ended up falling for him  and I let my mom meet him on 2 occasions so my mom was aware that her minor daughter was sleeping with a 38 year old. While with my partner we took photos of what went on in our "bedroom life" I never objected to these photos and I eventually personally took photos of my self when I was 17 and posted them on-line on a blog site I also exchanged photos of my self with him via photo messages on my cellphone. Low and behold I was reported to a missing and exploited child database because of my photos that were on-line. My house was searched by sheriffs January of 2006 six months prior to my 18th birthday. I was charged with 2 felonies and they found out about my partner and pursued charges on him also. I did not have to register as a sex offender all though it came up during my court case whether or not I should or shouldn't have to after completing a sex offender risk assessment they felt I shouldn't of had to register which I agree these were photos of my self not someone else. My partner on the other hand started out with one charge and was eventually indicted on 22 felony charges all related to pandering sexually oriented material involving a minor all charges were related to the photos he had possession of, of me. This court case really showed me that the justice system doesn't do justice, one because of the fact that they kept pursuing more charges on him not only that but they didn't keep in consideration it was all consensual. The screwed up thing about Ohio is that the legal age for consensual sex is 16 thats why they couldn't charge him with statutory rape but yet they could pursue charges on the photos because I was not 18 and its illegal to photograph a minor in a sexual act. How does think makes sense? I think sex is far worse than a photo! This case needs to be laid to rest its been over 2 years since everything started and its no where near done it took until June of 2007 one month before my 19th birthday for my partners case to finally come to an end luckily he was able to get a plea bargain where he plead guilty to 1 felony charge instead of taking the original 22 to trial. Part of his plea bargain was he had to register as a Sexually Oriented Offender for 10 years be on community control for 18 months, attend Sex Offender Classes and a no contact order was put in place that he was unable to contact me. I thought that would be the end but it hasn't been for him due to his felony conviction now the barbers board is trying trying to revoke his license so he can no longer cut hair He is currently fighting that in a civil case not only that but January of 08 they passed the Adam Walsh act reclassifying sex offenders into 3 different tiers since he is a sexually oriented offender under the Adam Walsh act that will make him a tier 2 offender meaning instead of registering 10 years and confirming residency annually he would have to register 25 years and confirm residency semi-annually how unfair is this to a person who doesn't even deserve to be classified as a sex offender everything was consensual I think that if he has to be compliant with the Adam Walsh act thats its double jeopardy because they are changing his original sentence! I will never view him as a sex offender because its something he should of never been labeled. The justice system was not out to help him like some offenders instead they were out to take everything from him. His freedom, His Insanity, His job, His life. I have not seen or heard from him since the day I had to testify on behalf of the state of Ohio in his case. I wish for the best for him and I wish people would realize every sex offenders case isn't the same and some people never even deserved to be classified a sex offender.

He was in possesion of child pornography which is a crime, irregardless of whether you took the pictures your self or not the fact is that he was in possesion of them.

Why in the world would this man lie to you about his age?

Sending pictures or putting images of yourself on line in compromising acts is foolish, once any thing is on line it is no longer your property, it in essence becomes public property.

The justice system did what they did whith in the lines of the law that they have implemented, they make no distinction between whether the pictures were of a seven year old or a seventeen year old, the bottom line is that it was child pornography.

As an adult with many years of living, he should have known that child pornography is illegal, he got caught and has to pay a hefty price, but the botom line is by having those photos in his possesion he was commitng a crime. Having child pornography in your possesion is a sexual crime so therefore the label sex offender fits, I am sorry if this is not what you want to hear, but it is the truth.

Your story is a good one for young people to hear! It teaches a very valuable lesson about child pornography, and what not to do and what tobe aware of.

I really do hope that you share this with other young people and also let them know that posting graphic pictures of themselves on the internet or via cell phone has very real dangers. you also stated that all 22 charges were realated to the child pornography in his possesion, sadly this individual did not have the foresite or maturity to not accept child pornography and went so far as to intice you to participate in it! Shame on him!
