(Original Air Date: 10/29/07) Fraud. lies. conspiracy. They may sound like the latest Washington scandal, but these are allegations of exes at war over child support. Dr. Phil's guests claim they became victims of the perfect crime when they were led to believe they fathered a child that was not biologically their own and were forced to pay. First up, Enrique says he was shocked and angered to discover he was not the father of his youngest daughter, Selina, and that she was conceived during his ex-wife, Maria's, adulterous affair. Maria says he raised Selina but then abandoned her to save money. Why does Maria say Enrique's current wife is to blame for the fractured relationship? Next, 13-year-old Selina speaks one on one with Dr. Phil. Will she decide to let the man she once called Daddy back in her life? Then, Carnell Smith, who uses the online moniker, "Man4Justice," suffered a similar fate to Enrique, and but he fought and won. He says he's tired of seeing women trap men and get away with it. A heated debate ensues between him and feminist attorney, Gloria Allred, who argues that men like Enrique should continue to act as the father ... and continue paying! Talk about the show here.

Maria should be thrown in jail, seriously.

Maria falsified legal documents! Not only did she falsify the birth certificate. She also falsified the documents she used to file for child support!

 

I can't believe Maria insisted that he should continues child support.... Ridiculous!

 

Not only should he stop paying child support.... she must reimburse him for all of the additional child support he has paid for the child that is not legally his. Furthermore, after he gets his money back, Enrique should definetly press charges against Maria for falsifying the documents and push for jail time.... He needs to contact his district attorney...

 

By the way, all of this is coming from a 22 year old man who's "dead-beat" dad never paid child support and who's mother is currently sueing for the $30,000 he owes. So, with that said, I fully beleive in chasing "dead-beat" dads and in the child-support system..... But Enrique is not the legal father! How can there be any further discussion after that?

 

And in rebuttel to that "lawyer lady" who tried to defend Maria (miserably).... yes, Enrique did some unethical and perhaps immoral things to the 10 year old.... but he didn't do anything illegal! In fact, Maria blatently commited fraud, and admitted to it!

 

WHERE IS THE ARGUMENT?

God bless the U.S.A. !!!!!!!!!!!  We need a lot of lousy judges off the bench is all I can say.  We need some stiff laws and to overhaul family courts, family law, and divorce laws.  They are all lopsided in favor of the woman and create a climate ripe for abuse. 

Keep in mind that this is after generations of the exact opposite! Im not advocating the immbalance.... But men are not all that innocent either.

I think it's sad that a mother can lie to the child for so many years, what if the girl starts dating a boy and it could end up being her brother, all because the mother lies about the real father. On another note this mother is lucky the only thing she came away from unprotected sex is a child. What if she came away with a HIV aids and a baby? Whats next she has aids, the baby has aids and the husband gets aids.

 

This mother deserves all the grief she gets and she should do everything in her power to try to unite her daughter and the father that took care of her for ten years. She should make the child realize that what Enrique did to her was all about getting back at his cheating wife and he was hurt and he does deserve a second chance. And then the mom should do her very best to find the biological father and introduce him to his daughter and make him pay for the product he bought 13 years ago.

You will have to go to court and read the statute outloud to the judge in order to keep  him honest.  You will have to point out how the previous ruling went against the statute.  That being you aren't even the father, the real father needs to be in court.  There are other statutes, laws, and cases you will need to be able to quote for the judge.  You need to have your paternity test results there as well.  Find the case won by the man on the Dr. Phil show the other day and that should help you find out what he used in court.   

 

You do not have access to the child, nor are you the father of the child.  It is really a matter of finding an honest judge (hard to do in family courts).  You'll have to do as the black man on the show did and not stop until you win.  I doubt your ex has a lot of money to keep fighting for a fraud she has committed against you.  I'd write every representative in your state and every family court judge and make them aware of your case.  I'd see every good attorney before she knew I was going to sue her and take her into court then she couldn't hire those attorneys.  I'd request that she pay for my attorney fees because she knowingly lied and created the situation where litigation had to continue, costing you money. 

 

 

I'd look up the man that was on the show and find out all he did to be successful in his case.  Then I'd do what he did.  I don't know if this guy had a lot of money for lawyers or not, but I have known some men who have won their cases without lawyers to get child support lowered and get visitation.  Your case is different than theirs as you aren't the real father and it sounds like you aren't going to try to have a relationship with the child at this point.  I guess your heart was broken and you have moved on, understandable.

 

You'll need legal help, it will cost you less if you get a law student to help you set up a good case.  Even a good lawyer would be worth it, do the math!  If you are avoiding child support save some of that cash and go to court and fight that vile woman.

 

Once I got the payments stopped I sue her for the total plus emotional suffering and make her pay interest and I would press charges of fraud on her.  If the district attorney would not move forward then I would make sure every newspaper and every news outlet in the state got word of it all at the same time. 

 

Once in a while a lawyer takes a case pro-bono, maybe you can find someone who is passionate about this sort of thing and wants to take the case or help you to represent yourself.

 

Good luck with your case!!! (disclaimer - I am not a lawyer or legal student, I am just interested in father's rights and those who get stuck with less rights than the average person because they are accused of being a father).

You may have to wait several weeks and upwards to get an appointment. But once you have the appointment, they work fiercely to interpret the law unbiasedly, quickly and for free!

Dr. Phil, I am sooooooo angry that you would give Gloria Allerd a voice on your show!  She is only about money and cares nothing about the truth.  How could you?!

12/25 Parent Trap

This story is so sad,  the dad made a mistake to tell the girl, but the mother should be responsable for what she did.  She want's to blame it all on him but she is the one to be blamed.  The daughter should be mad with her mother more than him, for being such a liar.  I think that if her step dad wants to adopt her he should have that privelage if the girl feels confortable with it.

Missing fater

Dr. Phil I was ecstatic to see the show that you did on paternity fraud.

I am a 36 year old mother that has a 17year old beautiful daughter who simply wants to meet her biological father.  I have contacted his father and his twin brother and no one will give me any contact information for him.  I am not seeking a paternity test of my daughter due to the fact that I don't want anything from him.  My daughter simply wanted the opportunity to meet him, to see him.  I don't know what else to do, and It is obvious that she has a void.  She recently made the comment in reference to her biological father, her step father and her God father,  She said that she has 3 fathers and the three of them to together only equals to a dead beat dad in her life.  My daughter found out when she was 12 years old that her step father wasn't her biological father, and we have been trying to reach her biological father every since with no success, its almost as if  his family is hiding him, I have stated to them on many occasions that we don't want anything from him, just for my daughter to have the opportunity to meet him.  I am lost and I don't know what else to do or where else to turn, I cant financially afford to hire a private investigator, so my daughter has been forced to carry the void that would be resolved in one simple meeting.

 

I hope there is someone that can help me or lead me to the proper person to receive help!

He should not financially pay

Firstly, I don't condone the decision that Enrique made to completely cut off relationship with his "daughter" Selena. However, I think can understand why he did so. Selena was the personification of his wife's betrayal. She had an affair with another man and did not come clean until he began to question Selena's parentage. She actively engaged in a lie to keep from getting into trouble. The girl he raised as his own was a product of lust, deceit and betrayal. Again, I don't condone his decision to completely cut Selena out. That was wrong. It was also wrong for the judge to force Enrique to pay for her support. Why can he not be a father without paying for this child who is not biologically his?

The situation would have been different if Maria told him right away that she had an affair and that her affair  called the paternity of Selena into question. They may have divorced and he would have had to pay nothing on the grounds of her infidelity. He may have decided to continue because his wife atleast told him right away instead of waiting nearly a decade. Had he known Selena was not his child right after she was born and made the choice to raise her as is own anyway, he would, in my opinion, then have been liable for child support after the divorce.

Maria's choice to come clean only when she was cornered bears the greatest burden responsibility though Enriques actions are most responsible for the emotional betrayal of Selena.
