(Original Air Date: 10/13/05) In a heartbeat, your entire life can change. No one knows this better than the families of Brandi and Daniel. Seventeen-year-old Brandi was a cheerleader, an excellent student and an all-American girl. She was in love with athletic 18-year old Daniel. Now he’s dead and she finds herself behind bars serving a 12-year sentence, all because of what happened in just a split second. Was it murder or simply a horrific accident? Hear members of both families describe how the tragedy unfolded, and the struggle to put together the pieces of their shattered lives. Plus, Dr. Phil visits Brandi in prison to ask some very hard questions. She has an emotional message for Daniel's mother -- and for Daniel. Talk about the show here.

What's wrong with our Judicial System?

As I watched this show I became more and more irritated that girl still remains in prison.  Those of us watching the show obviously we only have information from a hour long show which is not very much but what I can see watching this is that it was an accident on her part.  I really have a hard time believing that she is a cold blooded killer.  And the young man seemed to have some issues as well too bad that he wasn't able to get those worked out.   

  

Here is my problem, I believe that this was an accident.  In my State in the very recent past our US State Congressman was speeding on a State hyway ran a stop sign and killed a man on a motorcycle.  The Congressman was convicted in a jury trial of SECOND-DEGREE MANSLAUGHTER, speeding, running a stop sign and reckless driving.  He was sentanced to a mere 100 days in county jail, 3 years probabtion.  He  voluntarily gave up his seat in the House and lost his license to practice law which he is now trying to appeal, which he will probably win.  How is her sentance FAIR or RIGHT.  In my opinion its not.  100 days and he got out on work release for a quilty verdict on 2nd-degree manslaughter charges and she is serving 12 years for an accident?  I just think that there is seriously something wrong with our judicial system and it needs to be changed.

lawyer didn't bail

Just want to point out that the lawyer did not bail on her.  According to several newspaper accounts of the story, one of her first attorneys was appointed as a county prosecutor during the time between when she was charged and when the trial was supposed to take place (hit Daniel the day before Thanksgiving 2000, charged December 2001, one trial date was for September 17 and it was before this date that the appointment took place.  When an attorney accepts a position in the prosecutor's office it really is possible that he would no longer be able to remain objective and give the best possible defense. He defintiely would have a conflict of interest.  In this instance, he took the appointment and ceased to be her lawyer.  I would imagine that he probably stepped down from quite a number of cases.   

  

So her lawyer did not bail on her ....  

  

The circumstances of his withdrawal from the case however would have made it harder for this young lady to have continuity in her defense - even though she did still have one of her original lawyers.

If you were the only witness then Crystal and David are liars. They lied on national tv. Maybe you 3 should have got together and decided on just one story. So when it comes out you won't sound so guilty. So maybe Dr. Phil should get Brandi an attourney and get her out because from the way you all change the order of events of the night in question it seems to me that you all don't know what happened and for someone (you) say they don't have any hatred for Brandi I think you are full of dookie.
I was never on the show and don't care what you think! My story has never changed! I don't hate Brandi.....I don't even know her! I hate what she did and i hope she can forgive herself!

Sounds to me that maybe Brandi does need a new attorney.  The things i'm reading on here have got my attention and if nothing else, I would print out these posts - make copies.  Find an attorney for sure!  I am beginning to wonder now about many aspects of this case. 

Daniel and I just talked about getting married it was never formal!  It really doesn't matter anyway because Brandi KILLED him.

Thank you for the clarification.  This is very logical and makes much sense. 

  

Would it be possible for you to link to some of the old articles, if you can find them online so we can get more information on the case  to fill in some holes - or should I say canyons.

When she killed my twin brother she killed part of me too and that part will never come back.
I have twin boys.  They are four.  For them to be seperated for even an hour is traumatic for them.  They truly are "one half of the other." I truly am sorry for your loss.  I can not comprehend it.  I know twins share a bond that is even greater than that of a parent/child.  It is truly unique is every way.  I will continue to pray for you.

I see Stephanie on the board......

1.  I see no statements at all on here from Stephanie about the events of that night.  She does not tell her story.  Everything is second hand from Daniels family. 

  

2.  Crystal states that Brandi knocked on the door and forced her way in.  She (crystal) finally persuded Daniel to meet with Brandi.  They go outside.  No where does it mention Stephanie.  At what point did Stephanie come into the picture? 

  

3.  Crystal states that talking turned to screaming (Daniel and Brandi), but it was not until AFTER Brandi drove off that she called 911.  If she was not outside to witness these events, how does she know when Brandi left?  Again, where is Stephanie? 

  

4.  Crystal then states she dialed "9 1" "and I hear this loud boom that sounded like she hit a car. I freaked out. I dropped the phone, and I ran downstairs.”   Again, where is Stephanie? 

  

5.  Danny, Daniels twin brother stated " “I blame myself in everything that happened. All my life I’ve been a real light sleeper. If I had woke up, I could have stopped it. But I never woke up,” says Danny," but then he goes on to state "I call it murder, because Brandi did it deliberately,” says David. “It was premeditated. She waited up on top of the hill for 15 minutes before she struck him. 

  

If Danny was sleeping how does he know Brandi sat on top of the hill for 15 minutes waiting?  Again, where was Stephanie? 

  

There are so many inconsistencies in these stories, yet based on this we are too believe that Brandi's act was intentional.  We have Crystal who admits she was not there:  she was upstairs calling the police.   We have Danny who was admittedly sleeping, he never woke up.  Again, where is Stephanie? 

  

I find this all very disturbing.  According to Crystal, BOTH Daniel and Brandi were screaming.  Where was Stephanie?  What was she doing?  We KNOW from Crystal that BOTH Daniel and Brandi were emotionally unstable.  What we don't know is what really happened.  Seems the truth lies somewhere in the middle and Stephanie, if truly an eyewitness, can answer many questions as well.  I just wonder if she ever has. 

  


 

I have noted the corrections given earlier. 

  

Danny is Daniels Father. 

  

David stated that Brandi waited on the hill for 15 minutes.

You stated on this board that you were the ONLY witness.  Your relationship to Danny does most certainly matter.

Why were you not on the show?  Since you are 1 of only 2 living witness's of the events being discussed it seems you would have been.  Were you not invited? 

  

Again, what is your story that you state has never changed?  Unless I missed it, I don't see it on this board.
