(Original Air Date: 10/13/05) In a heartbeat, your entire life can change. No one knows this better than the families of Brandi and Daniel. Seventeen-year-old Brandi was a cheerleader, an excellent student and an all-American girl. She was in love with athletic 18-year old Daniel. Now he’s dead and she finds herself behind bars serving a 12-year sentence, all because of what happened in just a split second. Was it murder or simply a horrific accident? Hear members of both families describe how the tragedy unfolded, and the struggle to put together the pieces of their shattered lives. Plus, Dr. Phil visits Brandi in prison to ask some very hard questions. She has an emotional message for Daniel's mother -- and for Daniel. Talk about the show here.

She said that she didn't do it out of anger and that she didn't do it on purpose!!

I am sorry but I think that the mother of Daniel needs to get a life!  I know that she is sad and really hurt about the whole thing but she still has a son and a daughter to take care of and to love.  I know that she will never forgive Brandi for what happend but she does need to move on about it and live her life to the fullest not in anger and sadness!!!

I am currently watching today's show and I am so angry.  If Brandi was innocent, then why take a plea bargain?  She agreed to the plea bargain so now she has to live with the choice she made.  I feel for her family, but we all live with the choices we make...even the "accidents" we cause.  We live in Italy and their law states that if you are at fault in an accident resulting in death due to negligence, you may be sentenced to  12 years in prison and large fines.  Anything that empares your ability to react to your surroundings, is no different than drunk driving.  For her to think that she would serve only 120 days for a HIT AND RUN was ludicrous.  Her HIT AND RUN was no accident.  That may be why her plea bargain was for VOLUNTARY MANSLAUGHTER.  Live and learn...

I am totally shocked by the lack of remorse

This is the first time I have been upset enough to sit down and write to the show, but the total lack of remorse shown by Brandi's parents has finally done it. No wonder the girl is having a hard time accepting her punishement, it seems we all spend so much time worrying about the poor young people in JAIL! and forgeting about the reasons they are there.
 He brother is angry at a system that has locked up his poor sister, cause she killed someone., She got a raw deal! Not what she expected!  Its the lawyers fault ! Its the boyfriends fault ! Its the policemans fault !  Its the courts fault ! How come its never once her fault !!!!!!!!!!!  
 Its time we let the sentence that is handed out to be served , if not, why do we bother to hand one out in the first place.

It was stated at the begining of the show that Brandi told her parents that Daniel jumped in front of her car waving his hands and she hit him-What I would like to know is was there tire marks from her car trying to stop? Our instincts as human beings are to slam on our brakes or to swerv from whatever is in front of us, if there was no sign of her doing that then that showns that it wasn't an accident. Something else I don't understand is that she was afraid of him because he supposedly threatened her and her brothers life - but why did she go to is house twice that night why didn't she call the police and notify them of the treats? She also said that once she hit him she didn't stop to check on him because she was afraid he would kill her-he would have to be a powerfully strong person to be hit by a car and thrown 58 feet and get up and kill her. Her story doesn't make since at all, she contrdicted herself over and over again and tried to make it out that she was the victim. I hope she does have to serve the whole 12 years, me personally I think she got off pretty easy. Her mom stated that Brandi will have to live with this the rest of her life-exactly she gets to LIVE!!! What about Daniel??? 

  

And to her family - You ought to be thankful that you have your daughter. You can talk to her, you can see her, you can celebrate holidays with her, you can see her continue to grow, you will watch her get maried and have children. You want to compare your situation to that of Daniels family there is no comparsion what so ever, you have your daughter they lost their son. For you to even think that its remotly the same thing proves that you are heartless people. 

you hit the nail on the head with so many inconsistencies in her story, i believe her case should have gone to trail. Her parents and friends would have to deal with the fact that she had life without parole rather then the 12 yrs she got.  Brandi's family should be thankful for 12 years and move on before they screw the son up too.

WHAT WORLD ARE YOU ON???

I CANNOT BELIVE how disrespectful Brandis family were. They were bringing up information totally irrelevant to the subject in a evil way of trying to create a bad image for the family who lost thier son. I can not believe that the mother said that BRANDI will live with this the rest of her life so she needs to come home, because what is the point of her dealing with this in jail?" OK SO LETS LET ALL THE MURDERS RETURN HOME AND LET THEM THINK ABOUT IT. Yea im sure thats JUSTICE!!! COMe on, give me a break. I can not believe how ignorant and selfsish Brandi, her mother and her father are. My heart goes out to Daniels family and the poor brother of Brandi who seems to not even know whats going on. This is a real shame and I hope Brandi lives her life behind bars. Her answers were obviously an admission of guilt. AM I THE ONLY PERSON WHO CAN SEE THIS CHILD IS LYING??? Her responses did not even make any sense and I think it was clear Dr. Phil could see right through her......R.I.P. Daniel

Guilty

she is clearly guilty.  no question about it, especially since she tried to cover it up by putting a branch in the windshield cause she knew she did something wrong.  Not sure how long she should be in prison, but def guilty. Also, her family needs to understand who the victim is here, and its not their precious daughter.

Let her out

She has true remorse. A 17yr old don't belong in prison.  What horrers will face she face there. Will that help her be more sorry for what she did?
