(Original Air Date: 10/13/05) In a heartbeat, your entire life can change. No one knows this better than the families of Brandi and Daniel. Seventeen-year-old Brandi was a cheerleader, an excellent student and an all-American girl. She was in love with athletic 18-year old Daniel. Now he’s dead and she finds herself behind bars serving a 12-year sentence, all because of what happened in just a split second. Was it murder or simply a horrific accident? Hear members of both families describe how the tragedy unfolded, and the struggle to put together the pieces of their shattered lives. Plus, Dr. Phil visits Brandi in prison to ask some very hard questions. She has an emotional message for Daniel's mother -- and for Daniel. Talk about the show here.

03/16 Cheerleader Scandal

     First off my story doesn't change I go off of what was in the reports and if it does change what so ever its probably cause I was typing fast or something and misplaced some letters or numbers. Am I upset because people take Brandi's side of course not nor do I care. You say I was mean to the woman on there that wrote some letter. Was it Brandi's mom? Shes pretty much the only one I have responded to rudely what so ever. If it was someone else I don't recall.
      You say you know it was just a accident that you just feel it right? HMMM I guess your just some expert in this kind of stuff huh. Lets get the facts out right here and now shall we. Brandi steals her mom and dads car and drives 30 to 45 mins from her house to my dads house and barges in the trailer. My sister calls the cops. My brother, Brandi and Stephani go outside and Daniel and Brandi talk and yell at each other. Brandi throws Daniel most of his stuff and takes off up the road still leaving a skate and a necklace in her car. Her mom states that she was taking it to 1 of Daniels friends house but yet hmmm she drove the wrong way for that one. Anyways she sits there and then Daniel Crystal and Stephanie start walking up the street towards her. Brandi sees this and drives around the park to the other side of the street and sits there now facing my dads house. Crystal runs inside and calls the cops again and Daniel and Stephanie are at the house with my brother standing in the yard talking to steph who is on the porch. Hes facing to where his right side is facing up the street towards Brandi. Which states in the Autopsy report was where he got hit was from his right calf on up. While they are talking Brandi then speeds down the road and hits him. sending him a couple trailers up from my fathers. Now you want to match stories then match them correct. Brandi states she didn't know she hit him yet there was a huge hole on the upper corner or the windshield on the passenger side. If she was going the speed limit she states there would have been no way that hole would of been created and no way my brother would have been sent as far as he had gone. Now if she didn't hit him from the yard then she drug him and yet she still claims she didn't know. Either way shes lieing. On one of the police reports it states that she hit a deer there would be another lie. She goes home and sticks some lumber through the windshield to try and cover up what she had done and then sneaks back into the house and tells her mom and dad that someone had vandalized the car well there's another lie and a cover up.
         She should have never stole the car without a license first off and should have never gone over to the house where my brother was staying. Then this would have never happened. Then she hits him with the car and never stopped except to throw out his skate and necklace. and then leaves to go home and thinks of a way to make it a accident. now after all this is said and done and my brother being dead they want to say that my brother was abusive and he controlled what she ate.  OK well if this was so then why did she steal the car to drive over to his house if he abused her and then later stated that he supposedly said he would kill her. So now not only is she going to his house to meet with this man who supposedly hit her but now supposedly told her that he would kill her. Then if it was that bad why would she go over there in the middle of the night after her parents were asleep just to take him his stuff? Makes no damn since to me.
        If she was so good and innocent and all that crap then why with all her parole boards I know there were at least 3 of them. Did she get denied on every single one of them. The board is there to make sure you are fit to join society. They ruled that she wasn't. So come on you just feel that she is innocent then tell me why? Do you honestly think that us going up there made that much of a impact I do not. It might help but not so much them as it does for the people to go in front of the board and speak their peace letting all the hate go with it.
        You don't know me to presume that it sounds like I wanted or want revenge. I don't need to prove to you or anyone else my feelings. I speak truth that is from my heart and sometimes it is hurtful but does not mean I want revenge. I have stated many times before that I don't hate Brandi's Family in fact I admire them for what they have done. As far as Brandi when she gets out I don't care how she lives her life that is up to her not me.
        I have been through just about any and every bad situation in life you can think of and have bounced back up every time. And will continue to do so. You say that you feel sorry for me. I don't need your sympathy nor do I want it. I have to much going on in my life to have it revolve around Brandi in whether or not she gets out or not. I don't care! So does me not caring make me a bad person or one who just don't have a heart or does it just simply mean I have better things to do with my life?
          So do all the research you want it don't matter.  Yet u say your on the outside of the box looking in. Why is it you protect Brandi and everything she has lied about and done. You have just more excuses for her just because of her age at that time. She knew what she was doing. Spend your life researching and coming up with more stories and cases that has happened in our world. Do what it is you want to do. Whatever helps you sleep at night
Your forgetting the part when Brandi was so upset from crying so hard she forgot to put her car in park and the car was moving almost hitting crystal she was between your dads car and hers Daniel had to stop it and get it into park. So your Dads car was on the side where his trailer was and when the cops came it was on the other side of the road you also forget that Stephanie says she moved Daniels shoe which states in her depostion. No where does it say anything about a deer and in one of the statements Stephanie says she was by Daniel not on the porch. So which story is true. In the news papers it changes in all the reports its different which one is it. They were messing with Brandi when she went to jons house she was trying to get herself together. They were hiding behind the car. In crystal depostion she went around 2 times in Stephanie she went around 3 times who knows what really happened and in both its all different stories. So which storie is true. Why wouldn't Stephanie want to see if Daniel is okay and why in crystal statement they both had to look for him and in Stephanie statement she was the only one that found him. Why would it take so long for your dad to go out there with crystal being upset. I think everyone should read the depostions its very interesting.

Result of the hearing

If the result of the hearing is that she is getting out in 2011, then she in reality got life. There will be no future left for her (Even if she had been release this time I would have been doubtful if there was something to be released to).

 

Since my last post I lost a family member in a accident.

 

He was riding a motorbike and got killed by a tractor. Right now it is time for harvest and all farmers are up 48 hours in a row due to our whether conditions. The farmer was tired. My relative was on his way home from a task relating to his job.

 

He leaves a unborn child and fiancé behind. It was the driver of the tractor who caused the accident by turing left without looking over his left shoulder.

 

What would be the outcome? Properly a fine. Maybe loosing the license if the driver had one. (Farmers don't need license when they only use their farming vehicles crossing pulic roads only).

 

Am I satisfied with possible outcome of this trial that regardless of the tragedy which have struck our family. Yes!

 

Because I placed in the same situation as driver of the bike also would have died and accepted my faith if the alternative would have been to slow down in speed while in service for my firm. That disgrace I would have spared my family off based on our culture where our self-sacrificing contribution in our workspace means everything.

 

Mobility means loss of lives and this case has proven for me how lucky I am to live in a culture where we give discount in punishment when they are conducted on wheels.

    Well if this did actually happen I am truly sorry for you and your family to have gone through that. Just seems to be very much a coincidence to me since I asked you in the past post if you were only in my shoes.  And once again coincidence of the fact he had a fiance and a unborn child left behind hmm sounds familiar. But who was this supposed family member let me guess a brother? Excuse my cold heartiness but I just don't seem to by it.  Besides with your " Story" of a family member getting hit isn't close to what happened to my brother. He was in a car accident where he was driving and so was the other guy. My brother was in a hit and run by someone who didn't care what she did and sped home and tried to cover it up. Two very different scenarios. Once again I find it hard to believe about your story but if It truly did happen I wish your family the best of luck and send my condolences to his fiance.

   Also A life sentence is 35 years in prison, 80% or something like that get off in 17 years for good behavior. Shes done 6 or 7 years somewhere around that ball park. So no she will do 9 or 10  years of her sentence  thats quite a few off from being a life term. Will her life be different well yeah of course since she was in there when she was young the vast majority of her life. The main years were spent in prison so yeah her life will be different but not over. She has a strong family to help her cope when she gets out. But you all just don't seem to get it though. Shes had 3 hearings and every time was denied. This is on her no one else anymore. your perfect angel that you see on Dr. Phil couldn't get out with any of the 3 hearings she had because of her behavior.  Sure you can say well Life in prison is hard. I'm sure it is but thats just another excuse once again its up to choices. Yet all she continues on doing is making the wrong ones. The hearings are for inmates to check and see if they are capable of living back among everyone else. Whether they are capable of doing so or if they think they could be a threat to themselves or society. They ruled her as not being able to fit one or more of those cases so they denied her again.  She got in due to what she did. Like I said its up to her now and she cant seem to be good enough to get her own self out. The board told her it is up to her now to get herself out from now till 2011.

I've been doing my own research of this case and I know in a trailer park you can't go 65 and swerve in hit someone without losing control and not hitting a trailer anyone with common since knows that. Brandi didn't even have a license yet she hasent been driving that long. So let's think about this a unexperince driver going 65 in a trailer park swerving in the grass hitting someone and not losing control of the car without hitting a trailer there is not enough room to do that. I traveled from Cali to the trailer park because I wanted to see it myself I knew in any trailer park you can't swerve in that far hit someone and not lose control of your car not at that speed I'm sorry but brandi's story fits. I know either Daniel jumped out not thinking he would be hit or the witness is hiding something. I want to know how you can go from brandi sitting on top of the hill it was first said that it was 2 mins then it was 3 mins then 5 mins now you say 10 mins. Okay there is only one thing that happened that night another thing why does your mom say she swerved 2 in a half feet in there you say 3 to 4 feet in there nobody can even get there stories right. I've been doing a lot of my own research I've found so much evidence that proves that this was a accident. I think that there is more to this story then what was said by the witness. I feel it I know it. I'm wondering to, your family says to brandi's family that they weren't there either was anybody from your family crystal was inside when this happened the only one out there was Stephanie and I would really start questioning what she says. Do you have all the depostions really read it if you have it of what the witness says it would make me mad honestly and question what really happened. I know its easier to blame the whole thing on brandi but what the witness says does not make since and with crystal going inside you really don't know what really happened what if Brandi was telling the truth this whole time wouldn't you want the right thing to happen. She didn't even take it to trial because the knew lawyer just makes plea bargains I read up on it and with Brandi being only 17 and never being in trouble before took it because she felt that's all she can do not knowing the rest. If it did the lies would question the jury on what really happened that night they wouldn't know what to think because I'm sure most people don't know what to think because there are so many stories and only one thing can happen that night people do care and that is why everyone wants answers and in any situation that happens in life there is one story to everything and if there was one story to this it would of rest along time ago. You say should murders and rapist get out just cause they say there sorry well let's think about that rapist they look for someone to hurt they get off on that they enjoy someone suffering you can't compare that with this story because they want to hurt someone they get off easier then anyone and that's sick so with you saying that is really weird Brandi does not fit that so that's out that's talk about murders people that kill with guns are out to kill they don't care who they hurt that's there purpose that's another story it has nothing to do with this one. Brandi was not planning for this to happen that's the difference between every story and every case that happens in this world things happen that some don't mean to happen that's why they call it a accident I know you just look at it as Brandi hit my brother he died from it and you don't care of what is real about it because her car is what hit him but I know that it wasent done on purpose being the outsider and it looks like I'm not the only one because there is truth to every story and if the stories change there is something wrong and something is covered up. If you would look outside of your box you could figure it out I know its just easier to blame the person behind the wheel but come on look at all the evidence that was there can you really say that a 16 year girl got up to the speed of 65 swerve in hit someone where there are trailers not that far from the road and do this perfectly without hurting herself to a lot of people that sounds like a lie so I'm sorry that it makes you mad that people believe Brandi. It really sounds like you want revenge with the way you talk to people on here. A lady was telling you her hard life experiences and all you get out of it is the tax thing I think the way you talked to her was really hateful and if that's the way you are I feel really sorry for you it must make life hard I can't believe you don't feel nothing for that lady from what you've been threw that's really sad. I'm sorry that you really hate the fact that people want to know the truth and that people believe Brandi but I've never seen someone so sorry in anything I've watch that has to do with someone dead ever. And you honestly can't see how she really feels about it that's sad but then you had no feeling for that lady and what she's been threw so why am I gonna bother I know it made me sad reading what she wrote its sad that she had such a hard life but it made her stronger and she seems to be okay like you care. I just think you should think that if the story changes more then once you should question it that's what most people do. I know your gonna be pissed at this letter I wrote but its cool I'm expecting it. I'm sorry for your lose I hope someday you'll look at life different and respect peoples feelings a little bit better it will help you out in life.

    I just want to say I really appreciate your care for this. We have been wanting to understand this for a long time now and it's true we are still trying to figure it out to this day. We have tried to make the storie fit and its impossible really you can't reach the speed of 65 maybe 40 at the most but what can you do. I know that we may never get to have the real storie and we may never have it fear her first attorney was gonna take it to trial but he got put somewhere else and they referred the next attorney if we knew what we know now he would of never been her attorney thats for sure because of somethings we found later when it was to late. Brandi is my girl we know who she is and we all know as her family and friends that she would never have done this on purpose. Brandi is so full of love and life she has been threw so much and yet still holds her spirit. Brandi has got into some trouble just before her parole a girl was messing with her and hit her she never hit back and yet got a violation for it  we have the paper from that and she got another one for sharing food. Brandi has to sleep with one eye opened every night but you know she still holds her smile when she sees us. Brandi is someone that has been doing the best she can in there doing everything she needs to. Taking classes and making the best of it. I will never give up on this, When I see Brandi it breaks my heart because I know what kind of person she wants to be out here, Brandi wants to talk to teens about stopping the violence she wants to help others. I know what she goes threw in there it's hard I also know how she feels about this she's not the one that is writing on here it's her family and friends she has never even seen this web site and at her parole hearing this was brought up. I don't think its fear at all because this has nothing to do with her. We has her family and friends want answers thats all. We feel terrible that Daniel is gone and so does she and I truly know something else happened that night if you really look into her eyes when she is talking about it the pain is there for him. She is not a bad person at all and I could never imagine being in her shoes. She is trying to move on from this but Daniel will always be with her. She loved Daniel even threw what shes been threw before this she loved him as a person that will never go away. I love my Brandi and what I hope for the day when we can hug her for more then the time limit to be able to see her for more then a few of hours. We all know how much life means to Brandi and I know she will make something of herself because I know when she gets out she is going right to School and finishing what she started. Thank you so much Bballplayer for taking time out of your life for this. I'm very close to Brandi and I just want to say thanks

Tomorrow I have to go to the funeral. It wont be nice. The mother of the unborn child have been staying at her parents house since she left the hospital. It seems that she is able to keep the child regardless of the fact that she had to lie down for weeks when there was bleedings months back.

When I mean live then it is because in my society you can not start a new life if you are jailed past 25. There is not years enough. When you are about age 35, 99% stop setting new goals and target their retirement. It has been so due to people living generally longer and cutback in pensions. You cannot live in the present. You have to put money aside while you continue to pay 50-60 percent in taxes. Some people live 30 years after they retire. That is a lot of years to finance. I hope that her family is there for her once they is released so she can live off them and contribute a little now and then in the household - but future? No.

       Don't  misunderstand me. I wasn't trying to call you a liar just seemed too coincidental was all. I am sorry for your loss and hope you and your family and loved ones do OK at the funeral. As far as Brandi I agree with you a hundred percent about her life being rough after she gets out of prison. I think she will be fairly good though since she seems to have a strong family to help back her. They need to understand though that when she does get out that doing time on paper will be harder then with her in prison but I think they will help her cope through everything and do just fine. But yeah her life will be rough.

if you only knew...

I read these posts and can't help to think about how everyone feels sorry for Brandi's family.  I on the other hand have little sympathy.  Don't get me wrong they are very nice couple. What you guys don't know is that her dad has 2 children in Iowa that he has never tried to contact and from what I know another son, besides Brandi's brother in Missouri and I'm not sure if he talks to him.  Last I knew, no he doesn't.  Last time we saw Danny was a couple years ago when we went to a funeral.  My husband and I were recently engaged and they gave us their phone numbers and address and wanted an invitation, we even gave them ours. Remind you, before this, my husband had not heard from his dad in almost 10 years.  Well we did as they requested, we even sent Christmas cards for the past few years.  We have not heard one word from anyone.  So if they were so worried about spending that last Christmas with their daughter, what about his other kids and grandkids that don't get to see them????
