(Original Air Date: 10/13/05) In a heartbeat, your entire life can change. No one knows this better than the families of Brandi and Daniel. Seventeen-year-old Brandi was a cheerleader, an excellent student and an all-American girl. She was in love with athletic 18-year old Daniel. Now he’s dead and she finds herself behind bars serving a 12-year sentence, all because of what happened in just a split second. Was it murder or simply a horrific accident? Hear members of both families describe how the tragedy unfolded, and the struggle to put together the pieces of their shattered lives. Plus, Dr. Phil visits Brandi in prison to ask some very hard questions. She has an emotional message for Daniel's mother -- and for Daniel. Talk about the show here.

    I feel for everyone involved with this story and I agree that there is more to this than we know.  This boy was obviously worried and threatened that she would leave him and I feel that maybe this was his way of dealing.  Suicide?  Do not know if he would really go that far honestly.  Love can do strange things to people and young kids can feel like the world is coming to the end if they feel thatt the one person they love is going to leave them.  I do not think Brandi did this on purpose.  I feel and see her pain and remorse.  I do believe though that Daniel's family does not want to know the truth about what happened.  They just want to lay blame on Brandi and hate her for it.  No mother or father wants to believe that thier child are capable of hurting themselves but in the real world it does happen.  This was an accident whether Daniel did jump out in front of her just because he wanted to stop her or wanted to hurt himself.  I feel as if Brandi should not be in jail for another 12 years.  She is paying for this and will for the rest of her life.  She will never be able to forget this horrible accicent and that will affect her throughtout her growing years.  I see and feel the hatred that Daniel's family has for her and her family and it appears to me that they really do not care about other people's lives and that forgiveness and compassion are apart of life and if they could talk to their son he would want them to go on and remember him the way he was and not hold on to this hatred and revenge that they apparently have.  Everyone makes mistakes in life and most of us learn from them but for everyone in this situation to just let this destroy their whole being is not the way life is.  I am not saying that this is not a terrible thing for the family of Daniel to deal with and believe me that whenever you lose someone close if is very hard to deal with.  Feels like the whole world comes to an end and that you just can not go on but we have to that is what God wants for us and for some reason he tests us in ways that we will never understand.  He has a plan for Daniel and he is and always will be special.  The hatred needs to turn into blessings that he was apart of your lives even if it was only for a little bit.  All children are blessings and they need to remembered as such.  That is why I feel that Brandi is a child also and should be blessed by her family as well.    

This story is very very sad but one thing I have to say. The reason you need to forgive is because if you don't, you will be eaten up and you will just be filled with bitterness. Your son would not want that. Tfhe word of God also says that if you can't forgive, you will not be forgiven. I don't know about you, but I would not want to miss heaven because I would not forgive. I hope you will take this word as trying to help you and I pray that you will forgive and get on with your life and be with the family that needs you.  I will be praying for you.  Denise

I can understand how upset Daniel's family would be, but having Brandi in prison for life will NOT bring their son back. Justice and revenge are two differnt concepts and I think because this is still so fresh in their minds, they have misunderstood those two words! If Daniel was threatening suicide earlier in the realtionship and abuse to Brandi or her brother, there could have been some psychological problems with him at that time that would have placed himself in front of Brandi's car, making it NOT intentional on her part!

I feel so sorry for both families of this tragedy. What's almost worst than the tragedy itself is how neither family can seem to move on. God knows it is not easy to move on. I lost my baby brother in a fire so believe me I realize how hard it is. But blaming somebody, anybody is just so pointless. It won't bring him back, it certainly won't help them get through day by day. I'm not saying that she should have no responsibility for what happened. Why does appropriating responsibility on her have to mean constantly hating her and her family...... it just seems so pointless and I realize that a lot of people may not understand that. But the point is, is doesn't help. The only thing that will help is if her son were somehow not dead and that just isn't going to happen.  

  Further, I find it really amazing how, although neither family have the truth of what happened or what either the victim or the girl was thinking, they are so quick to endorse a version of the incident that serves them.... that makes it easier for them. And honestly, I don't think anyone knows what really happened here, maybe not even the girl or the guy that died. The only way that either family is going to get any closure here is if they accept the facts of the case for what they are. Confusing as they are. They're not the point. They don't change anything. Regardless of what happened, how it happened, the point is that this boy is dead and his family and friends and everyone who knew him, including that girl, will have to live with it for the rest of their life.

This shouldnt have happened in the first place. Anyone who says that Daniel deserved what he got needs to take a look in the mirror & admit what a horrible person you are. Accident or not Brandi should stay in prison for the full 12 years. Eventually she'll get out of prison and be with her family. She IS NOT the victim in this tragic story. Her family should take a grip on reality and see that Brandi committed murder. My heart goes out to Daniel's family. They will never have their son back and it isnt fair NO MATTER WHAT he might have said before his murder.I think Brandi is lying to herself and so is her family, she should just tell the entire truth at least she still has a life to live no matter where she is. I do believe Brandi knew exactly what she was doing when she hit Daniel.
 I completley agree with you, she knew excalty what she was doing. If he threatned her, which I doubt he did, WHY WOULD YOU GO AND SEE HIM?? She knew that he if really meant it, which he didn't, she's a lair.......She went over there to make sure it didn't happen and if that meant killing him she didn't care! She deserves more than 12 years, she deserves life!!

the power of forgiveness

Dr . Phil you are absolutely correct. forgiving the other family for what happened to their son has nothing to do with benefitting the other family, it is to benefit themselves. If the family who lost their son never forgives they will never heal. Then this tragedy will carry on for the rest of their lives. we sometimes think that by not forgiving somebody we are hurting them, however the truth is that we only hurt ourselves therby allowing what they did to hurt us even more. My prayer is the they learn to forgive, allow this terrible tragedy to some how make them stronger, and to focus their attention to the daughter they still have.

10/13 Cheerleader Scandal

  Wow, I can so relate to the family that lost their son. My Brother was killed in 1996 by a drunk driver.  It took a long time to realize that the grief and hatred was consuming my every waking moment. This not only affected myself by my children, husband and work. The all consuming hate  that I saw eminating from you on the TV was scary.  I miss my brother and know that his death was  quick and painless and that if he had lived he would have been left a vegetable he would have hated that.  I had to live every day knowiung that I could not go into the court room because That Woman took my brother.  And How dare she not remember. ( drunk black out.) At least that is how I used to feel.  

  About 4 years after his death I realized that I have no control of what others do to each other but I have control of how I treat other people and I really wasn't happy with the hate in my heart.  I felt sick all the time.  Once I spent some time thinking and talking about forgiving her, I was able to rid my heart of the sick and hate.   

  She was sentenced to 15 yrs and only spent like 7 in prison.  I ran into her at our bank and fell into the trap of shock.  How could the happen? I thought I forgave her.  I called my pastor and talked to him. He gently reminded me that I am not a Saint and that being human also means having feelings and that I didn't say anything to her and I didnnot embarrass myself or her in a public place. I don't mind being human but not a Saint (hahahaha) please. Remember if you want to be forgiven you need to first forgive yourself.  We are all human and accidents happen to the best of us at sometimes take away the people we will miss the most.  Remember LIFE IS SHORT and ETERNAL LIFE IS (well) ETERNAL.

I lived down the street at the time and I know that there is no way that Daniel would have done that...I just want that family to know that they are in my prayers...

 the only revenge she wants is to see Brandi in prison for the rest of her life. What you saw on the show was only one side. Daniel's family was barley questioned. All we heard was Brandi's story which she has had 3 1/2 years to make-up, they should talk to his other girlfriends to see if he really was abusive, which i doubt he was. I live in Liberty, mo and i know both girls,and Brandi, seems to me like a girl that wants attention and will do anything to get it. Her tears on the show today weren't real, she doesn't feel sorry for the pain she has caused. She is crying beacuse she is stuck doing a crappy sentence. I feel she desreves a life term, she took a life and now needs to pay the price. Put yourself in Dainel's family shoes, have a son in the prime of his life, horribly taken from you, wouldn't you waant to see the one who took him away to pay for what they have done? ANY PERSON WITH FEELINGS WOULD WANT TO SEE JUSTICE SERVED!! Our court system is messed up and this case proves it, she commited the crime and needs to pay. Yea this murder she will have to live with the rest of her life, but at least she will have a life.

I can relate with Brandi's story, i believe that she is innocent and I was in an abusive relationship as a teen, The guy I was dating was stupid enough to jump out in front of my car but regretfully I swerved... He got what he deserved and his mother is a low life that does need to get a life and and his sister needs to shut her trap as well..

I don't know if it was an accident or if Brandy planned to kill Daniel, but I do think that Brandy's parents should have more respect for Daniel's family.  Daniel's family was treated very badly on the show today, and it seems like Brandy's family is only concerned about getting her out of prison.  I understand that they don't want their child in prison, but she did committ a crime.  Her mom kept saying that she has already spent 3 1/2 years in prison and what is going to change if she stays another 12.  Her daughter killed someone.  Whether she meant to do it or not, she did it.  If it was a child molester or someone else that committed a crime, would they be released early?  Would Brandy's family want them released early?  I don't think so.  She needs to do her time just like everyone else does when a crime is committed.  What makes her so special?
