(Original Air Date: 10/13/05) In a heartbeat, your entire life can change. No one knows this better than the families of Brandi and Daniel. Seventeen-year-old Brandi was a cheerleader, an excellent student and an all-American girl. She was in love with athletic 18-year old Daniel. Now he’s dead and she finds herself behind bars serving a 12-year sentence, all because of what happened in just a split second. Was it murder or simply a horrific accident? Hear members of both families describe how the tragedy unfolded, and the struggle to put together the pieces of their shattered lives. Plus, Dr. Phil visits Brandi in prison to ask some very hard questions. She has an emotional message for Daniel's mother -- and for Daniel. Talk about the show here.

  That very thought was going through my mind earlier today. I think Brandi feels bad for what has happened. Whether she did it on purpose or not. She's not a psychopath,or else she would have interviewed Dr. Phil like a Scott Peterson!! She got angry,got caught up in the moment and crossed the line. But it angers me that people think she should get life in prison,or worse,the death penalty! It was not pre-meditated murder.

NO, SHE SHOULD NOT GET LIFE NOR THE DEATH PENALTY,BUT YES SHE SHOULD SERVE HER FULL 12 YR. SENTENCE.SHE TOOK A LIFE WHETHER IT BE BY ACCIDENT OR ON PURPOSE.THAT IS JUSTICE.

I think most people missed the whole idea of what Brandi's family was trying to say. They're not saying that she did not kill him, even she admitted that she did. They are, however, saying that they believe it was an accident. Think about it...if your child was in an accident, and killed someone, would you really think they deserved to do more time that rapists and child molestors? I'm not saying I think she's innocent. Personally, I don't believe it matters what I think. God will judge both of them. I was just trying to set the record straight. And Daniel's family does have closure...Brandi has been sentenced to 12 years of jail time. This will follow her for the rest of her life. They Know she was the one that killed him. And she did kill him (accident or no accident). I believe his family has got to try to forgive her. As Dr. Phil said, forgiveness is about them, not Brandi. Even if Brandi was to admit that she purposfully killed him, Daniel's family would still be in the same place they are in now. They are the only ones who can change how they feel.
THEIR IS NO CLOSURE,UNTIL BRANDI AND HER FAMILY STOP ARGUING THE INEVITABLE.THEY'RE TAUNTING DANIELS SPIRIT AS WELL AS HIS FAMILY,BY FIGHTING THE SENTENCE.SERVE YOUR TIME AND SHUT UP ALREADY!AS FOR HER FAMILY THEY NEED TO REFOCUS THEIR ATTENTION ON THEIR SON AND HELP HIM TO GET THRU THIS,THEIR NOT SETTING A GOOD EXAMPLE FOR HIM.THEIR ACTIONS AND SELF-CENTEREDNESS ARE RUINING THE SON. .GROW UP ,GET SOME COMPASSION,TAKE RESPONSIBILITY AND MAYBE YOUR KIDS WILL LEARN TO DO THE SAME.!!!!!!!!!!!!!

If you read between the lines of what each family stated on the show today, you would have to believe Brandi's version of the story. Apparently, Daniel had some issues because he was sent to live with his father. Add a resentment for women (due to the relationship with his mother) to his other problems, mix it with being 18 (changing hormones etc.) and you have a controlling, stubborn, and invincible (as Daniel probably felt) young man who would step out in front of a vehicle. I also would have like to seen Brandi's mom defend herself when Daniel's mom trashed her in her statement. It was totally unnecessary, and Brandi's family did not sink to that level. I wish Brandi's family would have been more assertive.

Remember why we have a judicial system I think Brandi's perfectionistic mother and unsympathetic father need to wake up and realize that what another 12 years (really a small price to pay for taking a life) will accomplish is what we call "punishment" to the guilty and "justice" to the victims (Daniel's family) in this country.  Every criminal guilty of killing in the heat of passion and emotions has the same story.  They are not helping Brandi by not allowing her to be accountable for her actions.  My heart and sympathy goes out to Daniel's mother, father, and sister.  It pained me to see them sitting there on the show with little support.  Stand strong and DO NOT allow this (Brandi's) family to think they are above the law and most importantly the justice you deserve.  I truley believe that if they showed more remorse and respect for your family, it might make it easier for you to forgive Brandi.  They need to really think about their actions and the impact they are going to have on their daughter.  My main worry is that she will get out one day and not having ever really taken ownership for her crimes - who knows what will happen the next time she is in a tough spot.  I wouldn't want anyone I care about to be her next victim.

   

Daniel's Mom, please do not stop going to Brandi's Parole - 12 years is not long for someone this young.  She has to stay in prison - she has shown no remorse.  You and your family hold true to your son's memory and know that you are not alone.  This show only brought out the worst in Brandi's family and they made themselves out to be the Tree not far from the apple. 

Brandi's parent's think they're above the law you say? I thought they were saying how the law screwed them over? "I wouldn't want anyone I care about to be her next victim?"you say. Oh,so now Brandi's a serial killer,huh? Where in the hell are you taking this story? You said her tears are for herself? How do you know? If I thought I was innocent,it would be hard to show alot of remorse too. Maybe she believes she's innocent,you don't know,so don't accuse her of being a cold-hearted person,there are REAL psychopaths out there,far worse.

BUT THE PAST CAN'T CHANGE.

TRUE!THE PAST CAN'T CHANGE,BUT YOU ALSO CAN'T GET AWAY WITH "MURDER"ACCIDENT OR NOT,IT'S A CRIME."ACCIDENT" IS HER CLAIM.TOO BAD WE CAN'T HEAR HIS.
