(Original Air Date: 10/13/05) In a heartbeat, your entire life can change. No one knows this better than the families of Brandi and Daniel. Seventeen-year-old Brandi was a cheerleader, an excellent student and an all-American girl. She was in love with athletic 18-year old Daniel. Now he’s dead and she finds herself behind bars serving a 12-year sentence, all because of what happened in just a split second. Was it murder or simply a horrific accident? Hear members of both families describe how the tragedy unfolded, and the struggle to put together the pieces of their shattered lives. Plus, Dr. Phil visits Brandi in prison to ask some very hard questions. She has an emotional message for Daniel's mother -- and for Daniel. Talk about the show here.

I am currently watching today's show and I am so angry.  If Brandi was innocent, then why take a plea bargain?  She agreed to the plea bargain so now she has to live with the choice she made.  I feel for her family, but we all live with the choices we make...even the "accidents" we cause.  We live in Italy and their law states that if you are at fault in an accident resulting in death due to negligence, you may be sentenced to  12 years in prison and large fines.  Anything that empares your ability to react to your surroundings, is no different than drunk driving.  For her to think that she would serve only 120 days for a HIT AND RUN was ludicrous.  Her HIT AND RUN was no accident.  That may be why her plea bargain was for VOLUNTARY MANSLAUGHTER.  Live and learn...

YEA!!!  WE ALL LIVE AND LEARN.  SOMETIMES SOMEBODY      (HIM)    WITH ANGER PROBLEMS CAN DIFINITELY SEND A PERSON OFF THE EDGE . ESPECIALLY WHEN THREATENED.  WE FEEL THAT THIS WAS AND ACCIDENT THAT HAPPENED.

How can you reach 65 mph on pulling out?

It has been said that she decided to leave to get away from him. How can one possibly reach 40 or 65 mph on take off?

Legalities and Letting Go

Two Topics in one.  First of all, many people whether they are innocent or truly guilty go the plea bargain route because in the case of a violent crime situation, most juries give the maximum sentence to "us regular folks".  Prosecuters weigh what might save the court system thousands of dollars in trials and try to get some punishment that a defendant will probably take. In this girl's situation (Brandi), her parents should have edited any and all motions/plea agreements that their lawyer was to submit before she signed them.  Her true innocence or guilt has no bearing to me - I just feel that people need to edit their lawyer's actions as much as they would their CPA or any other service profession that deals with important situations (especially one's life). 

  

Secondly, on a personal note, everyday, I have to see the woman who helped put my husband in prison for manufacturing methamphetimine.  At one time, we were heavily involved in drug use.  This woman helped raise my husband and he trusted her.  She wore a wire on him for close to a year.  She also wore one on me trying to get me to go with her to steal things to make meth with (I said no).  I was not married to him at the time.  She and her husband (who also wore a wire) deliver my newspaper every morning.  The newspaper says that they are the only way I can subscribe to the local paper.  I HAD to get over them because they were damaging ME.  We live in a very rural environment.  Once, she started turning around in my driveway, I called the newspaper office and told them why she should not do that because I might snap.  She does not anymore.  However, if I did not let it go, I would have eventually hurt her with a violent outrage - then, she would have won.  Dr. Phil is so right - people have to let things go for their own benefit or the other people "own" them.  I lost my husband for several years and it is difficult making it on my own on his farm with 12 hour shifts and all the farm work; however, the funny thing is that those narcs really saved my husband's and my life and our marriage.  It also got us off drugs.  The best revenge is living good.

she wasn't trying to gwt away from him! she sat up the street reving her engine for what seemed like 20 mins! then she floored it! we never thought she would aim for anyone!

I am very proud of my daughter, she is someone to be proud of.  She was not going 65, I know that on the police report it states that but the next police report states that she was doing between 35 and 40, she was going that speed because what was left in the car she was taking to someone elses house, she had no intention of stopping there.  There was a lot of her story that was left out unfortunately, like the fact that her first attorney was appointed by the prosecution as a special prosecuting attorney and he would be working side by side with him and it seemed like a conflict of interest.  Brandi has had to have a lot of help to remember the parts of the night that she has, and during this time there was a witness that come forward and told the same story, however, her new attorney said he knew him and that he was a crack head and would not be usable in court, we later found out that the witness on the other side worked for the attorney that took over Brandi's case, now to me that was a real conflict, but we didn't know until after the whole deal was over.  Now it makes since why her attorney would not talk to the other witness that said the same thing happened as Brandi had said, that she was driving out trying to leave, then he stepped out between 2 trucks, and not being an experience driver Brandi swerved to miss and clipped him with the front of the car.  The car had red paint on the front of it so she had hit something else as well, later we found out it was the mailboxes, but she doesn't remember that either.   

  

Thank you for taking the time to ask the questions so they can be answered, the reason Dr. Phil seemed to take Brandi's side is because he has all of her legal paperwork, so he knows the truth.

Dear Brandi's Mom, 

  

I truly hope you get to read this.  I have written many messages on here regarding my credentials, my knowledge of non-verbal communication that clearly showed she was telling the truth, and my experience and knowledge of trauma and dissassociation. 

  

I was also railroaded for crimes I never committed.  I know she is  innocent and the slandeorus things said about her make me sick. 

  

She is a remarkable woman with the strength and courage that most people will never have.  After watching  the show and her reactions it  was so clear she was telling the truth. 

  

What I would like to know is this:  Did a CSI investigator compare the tire tracks to see if they match the tires on your car?  If the tire tracks don't match she will more than likely get a new trial on that alone.  Are there pictures of those tracks?  Do you have receipts showing what tires you had on your car?  This simple piece of evidence that has been used to damn her could be the very thing that sets her free. 

  

Please get a private investigator to check this out. 

  

I'm sympathetic and praying.  Most people will never display the courage and character your daughter has.

Two Sides to Everything

First of all, I empathize with both families. You have suffered a great deal and no one except people who have been through a similar situation knows most of your feelings. There are other people out there who have been through this and if you can talk with them it would probably be of help and comfort. There are many facts to this case. Can we judge so quickly??? I have experienced the court system and lawyers in several different ways. I have served as a juror on a federal case. I have experienced the friend of the court system/judge myself and felt very wronged and not heard. I have had my children stand before a judge and deal with a lawyer. I have seen my dauther's friends family suffer from her dad's actions and the legal system.  I do want those out there, as I did, who think that the justice system is about truth, to know it is not so. My son, felt "forced" by his lawyer to stand in front of a judge and accept a plea that he was not comfortable in his heart doing. He was told by the lawyer and prosecutor to lie. Before going to court my son had tried several times to contact the lawyer and he did not return the calls. The lawyer left a message (after my son had surgery and had to miss court) saying, "Not to worry, we worked out a plea agreement like " ___ and I talked about." When my son went to court, a "replacement" lawyer was there that was unfamiliar with the case and the plea she explained to him was confusing and not what the original lawyer and my son had talked about.                               MY POINT IS: Could Brandi and her family have been misled?  Yes. Definitely.          Could she have felt pressured to accept the plea?    Yes. Definitely.                           Is everyone involved suffering???    Yes, Definitely.            Where is the justice???                 How can they heal???   It will take time, work, and faith. I do agree with Dr. Phil, Forgiveness is about healing yourself.  Although, it does not mean you forget (the incident that changed your lives or the precious young man, Daniel). Allow yourself to "feel" your feelings. It is O.K. to be angry, sad, or what ever else you may feel. Hopefully it can be done in a healthy way.              I sincerely pray for both families.              Bless you all.

The swerving tells everything unless she swerved to AVOID hitting him which doesn't seem likely. 

  

Hmmm... 

I agree that the investigation of this accident was handled poorly. I would like to believe that the prosecutor would have had these things taken care of if the case had gone before a jury.  I actually hope that if this doesn't die down that this case would go before a jury. Then maybe these questions could get answered.

I know that's easier said then done especially when you know in your heart she's guilty. I believe she knew did kill him intentionally because if it was really an accident she wouldn't have went home and try to cover it up. She may not get the punishment she deserves right now but there will come a day when she has to stand in front of God.......

She will stand in front of God as we all will.  And if she repents, believes, and changes her life will be forgiven. As we all CAN be.

Forgiveness

If either of these families ever have a chance to have any form of a life, they must all show forgiveness.  The family that lost their son must forgive themselves and eventually forgive everyone that is involved.  The family that has a daughter in jail has to forgive themselves also and forgive their daughter for the life she took.  I believe that the sentence for this crime is too harsh.  I think she was young and niave about how to handle what she had done.  Teenagers make terrible stupid mistakes and that is why they need more supervision that what  they are getting.

If this is in the public arena we need facts. We can say all we like about feeling one way or the other but facts definitely help.
