(Original Air Date: 10/13/05) In a heartbeat, your entire life can change. No one knows this better than the families of Brandi and Daniel. Seventeen-year-old Brandi was a cheerleader, an excellent student and an all-American girl. She was in love with athletic 18-year old Daniel. Now he’s dead and she finds herself behind bars serving a 12-year sentence, all because of what happened in just a split second. Was it murder or simply a horrific accident? Hear members of both families describe how the tragedy unfolded, and the struggle to put together the pieces of their shattered lives. Plus, Dr. Phil visits Brandi in prison to ask some very hard questions. She has an emotional message for Daniel's mother -- and for Daniel. Talk about the show here.

Sorry for all the mistakes I'm making today..

I just caught it.  In another of my posts (the one with the newspaper articles) I stated this showed Stephanie was lying when she stated she and Daniel was not engaged. 

  

What I meant to say was this shows Stephanie is lying when she states (quite obnoxiously I might add) that Brandi and Daniel were not engaged.   Unless, she did not know - but after all this time I don't think that's at all possible.

Brandi's Attorneys

Another issue I see is Brandi's family's compaining about her attorneys.  In Ohio, not just any defense attorney is qualified to handle a death penalty case such as First Degree Murder.  For example, in my rural county there are only two such qualified attorneys.   I noticed in my search that one of her attorney's, William Shull, apparently also defended a guy whose case was on Court TV involving a carjacking in which a child was dragged to death which was going on about the same time as Brandi's case.  Just because your attorney isn't free to devote 100% of their time to your case doesn't mean you were not adequately represented!  Being a cheerleader only buys you perks in school.

She was obviously going fast enough to kill someone!  Even if you're afraid you aren't allowed to use your car as a weapon.   Please don't tell us you feel it was self-defense!

Face it, none of those kids were ready for adult relationships - they were teenagers in love with the idea of being in love.  I think that's what the show was supposed to be about... making what are in hindsight obviously bad decisions that have lifelong consequences.

I don't have issues with cheerleaders except that I used to be one in high school.   In retrospect I see now that it was ALL about status as a teenager - non-cheerleaders may not have been looked at as "have nots", but being a cheerleader surely placed you on the "have" list.  I think it goes to the issue of Brandi's family's perception that Brandi has been "wronged" by the legal system - that she had never been in trouble before so she should get a pass on her sole "oops".

Besides, the topic of the show was "Cheerleader Scandal".   It wouldn't have been so "scandalous" if Brandi wasn't perceived as a squeeky clean cheerleader from a good family who made one mistake in life.

Why are we?  I went to this site and went through the archives and searched by name (which is an education in and of itself) and found the court case #CR101-000140.  Perhaps it's my computer but I found getting that far rather exhaustive (and yet I persevered - go figure?)    

After finding the court number I was able to enter the number in a place where there was an option to search by case number and then a screen popped up with information about the case.  We have highspeed internet and this form remained blank for a lonnnnnnng time before the information finally popped up.  There are entries (not exhaustive detail) about just about everything -- probable cause warrants issued, request for discovery, arraignment, advisement of right to counsel and, plea, continuances, motions for reduction in bond, bond posted, waiving preliminary hearing, entry of second attorney, further arraignments, waivers, motion for discovery, depositions for Greg Arnold and Crystal Mize, reduction of bond, withdrawal of first attorney,entry of third attorney, trial date set, plea to lesser offense, sentencing hearing set, sentence pronouncement, motion to reduce sentence, etc.   

Very interesting what is in the public domain at the click of a mouse --- well several mouse clicks, that is.

I went there, too.  I was a little disappointed because in the county where I live in Ohio you can also pull up the arrest reports, the probably cause statements the police use to get the arrest warrants.  The 7th Circuit Court website IS cumbersome - I salute you for getting through it if you don't do that all the time!   I was hoping to see a copy of Brandi's police report!
