(Original Air Date: 10/13/05) In a heartbeat, your entire life can change. No one knows this better than the families of Brandi and Daniel. Seventeen-year-old Brandi was a cheerleader, an excellent student and an all-American girl. She was in love with athletic 18-year old Daniel. Now he’s dead and she finds herself behind bars serving a 12-year sentence, all because of what happened in just a split second. Was it murder or simply a horrific accident? Hear members of both families describe how the tragedy unfolded, and the struggle to put together the pieces of their shattered lives. Plus, Dr. Phil visits Brandi in prison to ask some very hard questions. She has an emotional message for Daniel's mother -- and for Daniel. Talk about the show here.

Why are we?  I went to this site and went through the archives and searched by name (which is an education in and of itself) and found the court case #CR101-000140.  Perhaps it's my computer but I found getting that far rather exhaustive (and yet I persevered - go figure?)    

After finding the court number I was able to enter the number in a place where there was an option to search by case number and then a screen popped up with information about the case.  We have highspeed internet and this form remained blank for a lonnnnnnng time before the information finally popped up.  There are entries (not exhaustive detail) about just about everything -- probable cause warrants issued, request for discovery, arraignment, advisement of right to counsel and, plea, continuances, motions for reduction in bond, bond posted, waiving preliminary hearing, entry of second attorney, further arraignments, waivers, motion for discovery, depositions for Greg Arnold and Crystal Mize, reduction of bond, withdrawal of first attorney,entry of third attorney, trial date set, plea to lesser offense, sentencing hearing set, sentence pronouncement, motion to reduce sentence, etc.   

Very interesting what is in the public domain at the click of a mouse --- well several mouse clicks, that is.

Brandi is where she belongs.

I was a very good friend of Daniels. I can't believe there is still the question of if Brandi is Guilty or not. This went to court and she is in prison for what she did. Daniel was the most loving and caring person I have ever known and for someone to say that he said he would kill himself if she left him or that he stepped out in front of her car is crazy. Brandi is where she belongs. Even if she serve's her whole sentence, she will have a full life to live, does Daniel? NO. She deserve's everyday she gets in prison and I hope it's hell because all Daniel's family and friends are living that everyday.

I don't know who he is.  

 I don't know why Steph's deposition isn't listed, but I believe that she gave one. 

It is quite interesting and moreover saddening once you are able to search by name to see the records involved with each family involved.   

  

You can see civil cases going back and criminal matters -- and the more I read, the more my heart goes out ... to children who had to grow up way too fast in circumstances that were far from what they needed.  The spillover from this is evident in the civil cases cited with some of the individuals present on the Dr. Phil show and criminal also.   

  

It just goes to show that the Dr. Phil show only scratched the surface with what was revealed concerning the past.   

  

I am not trying to say that any of this would take away from the responsibility that Brandi holds for her actions that night.  I am just pointing out what I suspected when you search and dig deeper .... that life is HUGE and a one hour Dr. Phil show just didn't give anyone enough information to decide this case make totally informed decisions about some of the other parties involved.   

  

It was - what it was.  I will be praying for all of these people.  They hurts that need healing started long before that fall night.

I was not able to search through.  The engine for some reason shut down on me. 

  

Civil cases?  What type of civil cases?  Is someone suing someone? 

  

It is terribly sad and this is why i hate these 1 hour shows.  I don't usually watch the talk shows.  I'm not sure why I watched this particular one. 

  

 I think in cases like this people are explioted - though it may well be willing.  Brandi's family so they can draw attention to her case.  Daniels family because they feel they need to be there to present Daniels case.

JUSTICE!!

It is such a tragic thing that happened in this story. Whether what Brandi did was an accident or intentional gives her parents no right to assume that Daniels parents are seeking revenge, what about JUSTICE, their son is never coming back. Brandi is!

The family did not assume. 

  

Daniels mother stated on national television that she wanted revenge.  Heck, she went so far as to say she wants Brandi dead - "a life for a life."

I'm not saying that you guys weren't talking about getting married!  Calm down, I'm not attacking you!  If anything I am on your side!  I was just wondering why Brandi said they were engaged and had the ring and everything.  I didn't know Brandi except she was a quiet kind of shady girl in my math class who one day was so happy because she was engaged and was sporting a 1/10 carat on her finger, the next was crying because the engagement was over, and then we heard a little later that she had killed the guy she was supposedly engaged to.  I just want to get the whole TRUE story.  It is obvious all parties involved are lying to some extent.  There have been too many rumors gone around town since it happened.  I think everyone just wants to know the truth, it makes our town and LHS look like a bunch of maniacs.  Stuff like this isn't supposed to happen there! 

  

I will also say that at Daniel's graduation (or when he would have) he deserved so much more than what was done for him.  I was so sad to see that he was barely recognized and a girl who drove drunk and killed herself was honored and a scholorship was opened in her name.  I honestly wish there were a scholorship fund in Daniel's name.  He deserves it way more than the drunk girl.  I am so sorry for Daniel's family that this happened.  I never knew him, but something like this should never happen to anyone.

This story really brought back a lot of memories for me. It also made me pleased about the way my family handled our own tragedy(I'm not sure if pleased is correct). But I think we did the right thing that my brother would have approved of.  On January 7, 1979 my brother, Roger, was shot and killed by one of his best friends (Hal)while they were at a cabin that we owned about 50 miles from here. My brother and I were born on the same day, two years apart. Eleven days after his death would have been our birthday. I turned 26 and he would have turned 24. We both lived at home and had no significant others.  Our parents were married 16 years before they had any children and we were their lives. I know what it means to be the sister left when the brother is gone suddenly for no reason  I know how the parents morn the death of the only boy. No one else will ever carry my father's name. It nearly killed them both.  Ironically, my mother died 6 years to the day that Roger was buried. Roger worked the graveyard shift at the County Jail as a jailer (he was studying to take the test to become a county cop). Hal had worked in the Caterpillar factory but was off work for some reason.  They left on a Sat night to go to our cabin at Anderson Lake and were going to work on the stone fireplace we were putting in. The next thing that I knew was at 10:30p.m. on Sunday night my Mom woke me to tell me that somebody named George was on the phone and wanted to talk to me. I picked up the phone and my life changed in an instant. He identified himself as the coroner of that county and told me that there had been a shooting and my brother was in Graham Hospital Morgueand also that they had Hal in custody. I guess a difference between what happened then and the story on the show is that Hal didn't try to leave.  They even tested the car to see if he had and he hadn't. I went to the cabin and got to see him that night and a sadder sight I had never seen.  I don't know when I first heard that Hal said that he had been playing with the gun while Roger slept and that it went off over his shoulder as he played and lodged in my brother's brain killing him instantly. I do know that Hal ran to the highway and tried to flag down help when the ambulance that he called couldn't find the cabin. I know that these boys had been friends since second grade and that they loved each other. I even know that Hal had always been kind of a screw-up but when I reached the cabin and was told that Hal said that it was an accident, I told the states attorney, standing in our own cabin, knowing that my beloved brother was gone forever--I told him that the family had no doubt that this was an accident. And at the inquest after our friends at the county sheriff's department told us that it Could have happened the way that Hal said it did, my father and I both asked for leniency.  He was convicted of reckless conduct (he thought that he had emptied the gun but never counted the bullets). He did not serve any time but had to go to alcohol treatment. I beleived then and I still believe that it is what my brother would have wanted and if the places ahd been reversed I like to think that Hal's family would have done the same. I feel that Life is full of choices. Sometimes we set ourselves on a course that can lead to tragedy. The guys always "played with guns," although Roger was the expert. He should have secured his weapon, Hal should have been more careful, we could go on sand on. I've simplified the story but that is pretty much what happened. My mother always said that she could forgive but never forget and she never saw or spoke to Hal again. Our family was broken and we will always morn and think of what might have been.  WE didn't see the need for Both families to lose their sons. Even now, so many years later I cry as a write this.

That was a horrible thing to say.
