The guy that's going to court to defend his constitutional rights is a selfish idiot! I would never consider myself a prude and definitely believe in sex before marriage; otherwise you end up married to someone with whom you're incapable of having a good sex life. But, if a guy doesn't want to have a child with a woman, nor the responsibility of creating a child, then he just shouldn't have sex with any woman until he's mature enough to handle the possibility of bearing a child.
I think Dr. Phil is absolutely correct in telling this guy that he shouldn't have sex with a woman unless he's in a committed relationship. Otherwise, the possibility always exists that she could get pregnant and might have the child. The woman is the one who should decide what becomes of the fetus. She has to carry it for 9+ months, nourish it, bear the trauma and pain of childbirth, lose her once perky breasts to feed it and live with the scars of it all for the rest of her life. Most of the time, she is also the only one who nurtures and cares for the child.
However, if the male is totally opposed to have a child then he doesn't have to be in the child's life if he chooses that option. If he does choose not to participate in the child's life, he will regret his decision either later on in his life when he's lonely or when the child finds him and/or when he has to answer for his selfish actions with the higher power. The woman who decides to bear his child without his consent should be prepared to raise this child on her own, but the child didn't ask to be here so both parents should pay the price of making these decisions - literally pay - the male has to pay child support . He chose to have sex with a woman who is not barren and that's the price he has to pay.
No, there is no birth control that is 100% so if you want to have sex and don't want to take the responsibility of her choice of whether to have the child and raise it or whether not to have it or keep it, then you'd better make sure that the woman is totally incapable of bearing a child. The only way to ensure that is the woman has to have had a hysterectomy and does not have a womb to carry a child.
If you don't trust whether the woman is totally barren, then either ask for her medical records or buy yourself a playboy and play...boy!
And yes, Dr. Phil, this will be a huge trap door for all the dead beat dads. If you ever watch "Maury", you will know that there are a lot of them out there and they'll all get away with impregnating a lot of women with their sperm and leaving the women to deal with the consequences. For those men and the idiot on your show today, have they ever thought of the mental horror a woman must go through in the decision to abort a baby? Some women are never privileged to bear a child ever again after having an abortion. Maybe we should "abort" a man's testes when he thinks a woman should have an abortion rather than be a man and step up to his responsibilities.
