What is not mentioned is that the passenger who was forced to sit in the lav was traveling on an employee pass, not a revenue ticket. He only got the last seat because the flight attendant gave it up for him to get on the aircraft. That in no way means what happened should have happened, but for him to sue is incredible! It should be investigated by the FAA and the appropriate personnel fined, as allowed by the law.
