Custody Battles and Drug Use

Dr. Phil tells Alex that from experience he knows the investigations and evaluations that will take place during her custody battle. "It's not really determined on what position and condition you're in today. It's determined by what position and condition you are in at the time of determination. Which means that no matter what's going on now, you've got time to clean it up," he tells her. "You've got time to clean your life. You've got time to put yourself in a position to be able to go into court and demonstrate your fitness as a mother and maintain custody of the children."

 

Dr. Phil implores Alex to be honest with him about her current situation. "I need to know what's going on: good and bad," he says to her. "There's nothing we can't fix." He asks her what she needs to clean up before she goes to court for custody.

"I would want for Tony and I to both have steady jobs and have a regular income," she says.

[AD]"Are you doing any drugs?" Dr. Phil asks.

Alex shakes her head. "I'm not doing drugs," she says.

"I'm not saying you are," Dr. Phil says. "I'm saying if you are, you need to put it on the table so we can fix it."

"If I was really doing drugs, I would ask you for help," she says.

Dr. Phil assures Alex that if she asked, he would make sure she got help. "If you're not doing drugs, then don't worry about it. But if you are, it's going to bite you in the ass," he says.

"Is Anthony doing drugs?" Dr. Phil asks Alex.

"No," she replies.

"Did you and Chris do drugs?" Dr. Phil probes.

"We smoked pot, once or twice," she says. "I don't smoke pot."

[AD]Alex admits to trying cocaine before Nathan was born but says she hasn't done it since. "Now I have kids, and they're more important to me than that stuff," she says.

"You're going to be asked all these questions. Believe you me, the allegations are going to be made, so we just need to talk about it," Dr. Phil tells her.

"I'm ready for it, because I'm not doing anything wrong," Alex says.

Alex was in a serious car accident four months after Leilah was born. She clipped a Hummer, hit a palm tree and spun around in the middle of the road, totaling her mother's Mercedes. Alex sustained a broken back and fractured ankle. Marty and Erin are concerned that the car accident led Alex to abuse pain medication.

[AD]Dr. Phil asks Alex if she still takes the pain medication, and she says no.

 

"So, you're drug free?" he asks. "You could take a drug test at any time and be drug free?"

"Yeah," she says.

"They'll ask you to do that," he tells her.

"I'm ready for that," she says. "My mom called the Department of Children and Family Services on me. They did an investigation. I was proved a fit parent, so if anyone wants to say otherwise, they can read her report."
